SCOMET stands for Special Chemicals, Organisms, Materials, Equipment, and Technologies. These items are listed under India's Foreign Trade Policy due to their potential dual-use nature. Exporting such items without proper authorization can lead to severe legal consequences, including hefty fines and imprisonment.

Items in the SCOMET Category

The SCOMET list is divided into eight categories:

  1. Category 0: Nuclear-related materials and technology
  2. Category 1: Agents of toxic chemicals and other substances
  3. Category 2: Microorganisms and toxins
  4. Category 3: Materials, materials processing equipment, and related technologies
  5. Category 4: Nuclear-related equipment and technology not covered under Category 0
  6. Category 5: Aerospace systems, equipment, and related technology
  7. Category 6: Munitions list
  8. Category 7: Electronics, computers, and information technology, including information security
  9. Category 8: Avionics, maritime, aerospace navigation, propulsion, sensors, telecommunications and lasers, electronics, computers, material processing, information security, and special materials and associated equipment

Guidelines and licensing agencies vary by category. For example, the Department of Atomic Energy manages Category 0 licenses, the Department of Defence Production manages Category 6 licenses, and the Directorate General of Foreign Trade (DGFT) manages Categories 1, 2, 3, 4, 5, 7, and 8.

SCOMET License Application Process

To obtain a SCOMET license, follow these steps:

  1. Registration: Register on the DGFT portal.
  2. Application Submission: Fill out the Aayat Niryat Form (ANF) 2E and ANF 1, providing detailed information about the item, end-user, and purpose of export.
  3. Documentation: Attach necessary documents, including technical specifications, end-use certificates, and purchase orders.
  4. Review: The Inter-Ministerial Working Group (IMWG) reviews the application, considering factors like the credibility of the end-user and potential risks.
  5. Approval: Upon approval, the DGFT issues the export authorization. 

Validity and Renewal of SCOMET License

The normal duration of a SCOMET license is 24 months. After being approved by DGFT headquarters, it can be revalidated by the DGFT regional office for a maximum extension of one year, plus an additional six months.

Consequences of Non-Compliance

If SCOMET products are exported without the proper permission, it may lead to:

  • IEC Suspension: Suspension of the Importer Exporter Code.
  • Legal Penalties: Imprisonment for at least 5 years, which may extend to life imprisonment, along with fines ranging from INR 3 lakhs to INR 20 lakhs or five times the value of the exported items.
